MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROUNDUP HELD ON MARCH 15, 2022 AT 7:00 P.M. IN THE

CITY COUNCIL CHAMBERS AND GOTO MEETING.

The meeting was called to order by Mayor Jones. Clerk/ Treasurer Lanter conducted roll call with council members, Long, Liggett, Vivirito, Erickson, Carlson, McCleary, Toombs, and Fisher present. Also, present were Director Sibley, Assistant Clerk Mann, Compliance Hoiland. Attorney Brooks was present by video.

Moved by Vivirito seconded by Liggett to approve the minutes of the March 1, 2022 meeting. All in favor. Motion carried.

Moved by Fisher, seconded by Toombs to approve agenda, adding Library Board meeting. All in favor. Motion carried.

Public Comment: No Comment.

Mayor Jones - Will be in Helena tomorrow and Thursday for Leagues Board meeting. Will be in Great Falls, Rural Water 23rd-25th along with Lon and Tanya.

Did research on Law Enforcement local agreement. Talked with Mayor from Choteau. Half of their mills go to Law Enforcement. Law Enforcement gets $157,000.00 a year with an increase of 3% every year. Lesnik reviewed the draft, doesn’t see an incentive of increase in the draft.

Bev Eiselein came in with some requests form the city. Would like the city to consider snow plowing all streets in Roundup. Suggested a ballot initiative. Lon has input on the cost, $100,000.00 for all streets to be done one time. Would have to contract it out, don’t have the equipment to do it ourselves. Mayor will have an Infrastructure Committee meeting, April 5th at 6:15pm. Toombs will fill in for Liggett.

Attorney Brooks: Arrange phone call with Kelly Lynch about Interlocal agreements. Will make himself available when County is ready to have a sit-down meeting to discuss agreements.

Compliance Officer Hoiland: One permit. Five people looking at building homes.

Mayor Jones asked if Bruce can let Tanya know if he needs changes to his budget. Hoiland doesn’t think he does.

Council Discussion/Future Agenda Items:

Report out from Council Committee Meetings:

• Water Authority: Liggett-Signed contracts for Phase 1. Spending Bill passed. ARPA 2.4 million approved for Phase 2.

Director Sibley- Pre-Construction meeting will be April 13th at 10:00am for Rural Water.

• Library Board: Toombs- Doing well. New computers for public. Signs for parking. County gave their portion of money. State gave 3 hot spots for public to check out for free for 2 years.

• Parks Committee: Vivirito- Discussed options for money offered by Donna Marmon with Swimmers Forever. 1) Purchase or donate for pool area. 2) Swim suits for Lifeguards. City pays for first suit, second suit or replacement suit, they pay for themselves. Policy could change if it gets too expensive. 3) Reject money.

Tanya called Rocky; they have a swim lesson class for Pool Managers. Council agrees to make Swim Lesson Class the number 1 option. Liggett thinks it would be good if the money was disbursed directly from Swimmers Forever. Council good with priorities.

Edge of new playground area. Something needs to be done with it. Whether is be sod or synthetic grass. Might be expensive at first, overtime, synthetic would be better option long-term. Will ask Signal Peak for funds. Options; 1) Sod or Synthetic grass. 2) Lights. 3) Mower for Golf Course. 4) Sidewalk around stage. Applications for grants mid-April. Erickson- Great West do Coal board Application for sidewalk at stage. What’s the price on synthetic grass? Mayor gave a handout and Lon will do more research.

Lifeguard interviews will be the 21st at 4:00pm.

Clerk/Treasurer Lanter: Handed out Treasurers Report. Audit completed.

Director Sibley: Benches almost completed, will install soon.

Council Action Item:

ARPA BONUS PAY FOR TELEWORKING EMPLOYEE: MAYOR ASKED BRUCE EARLIER IF HE WANTED TO CLOSE THE DISCUSSION ON ARPA BONUS PAY OR LEAVE IT OPEN. HE WANTED THE MEETING TO BE LEFT OPEN. NO MOTION.

Public Comment. Hoiland- I have no idea what was presented to you, but I know what I received. Toombs and Griffith brought up to pay ARPA funds, it’s in the minutes. Heard nothing for 6 months. Not good communication. Awhile back, memo handed to me, it’s a sham, Attorney not present at the beginning of this. Do you know what telework is? Was gone for two days, computer was at work office, never brought it home, never brought anyone to the office to discuss work. Council says I’m ineligible. I didn’t want the money, would have given it to little league.

COUNCIL CHAMBERS AND GOTO MEETING.

The meeting was called to order by President Toombs. Clerk/ Treasurer Lanter conducted roll call with council members, Vivirito, Erickson, Carlson, McCleary, and Fisher present. Also, present was, Director Sibley and Assistant Clerk Mann. Attorney Brooks, Long and Liggett were present by video.

Moved by Fisher seconded by Carlson to approve the minutes of the March 15, 2022 meeting after correction is made to motion on claims. All in favor. Motion carried.

Moved by Carlson seconded by Vivirito to approve agenda, adding wind farm, Golf Course and bids for restroom project. All in favor. Motion carried.

Public Comment: No Comment.

• Visitors: Delores Desjarlais representing the Tree Board- Gave an update. Arbor Day will be held April 22 at the stage at 10:00am. Would like the city to approve placement of a sign received from the Arbor Day Foundation for 30 years as a tree city. Will plant a tree in memory of Bob Yates. Biggest challenge is lack of volunteers. Walmart donated 100 bags of mulch.

• John Husar of Ponderosa Wind - Him and his son are developers from Billings, transmission lines will run from Snowy Mountain Road to Roundup substation, across the Golf Course. 40-year lease. Property taxes will go to county. Asking the city to consider easement for lines. Construction late 2023. Will do a detailed map at next meeting.

• Brad Marking for Justice Court Agreement - Looked at the contract. Sandy is all about where the money goes. #3 is not my clerk’s job. Will negotiate that one, might be able to do quarterly. We will never have to use the city’s room. We will do everything at our building. Picking paper up from the city, works for us. The word, if necessary, needs to be removed, that makes no sense.

Sandy said it was my idea to move, no it wasn’t. I’m on call 24/7. I get calls in the middle of the night. I want compensation for always being on call. A resolution must be done.

President Toombs: Des Multi-Hazard Mitigation Plan was given to the city. Training April 25th 6:30pm. Vivirito and Fisher said that’s a conflict with another meeting at the Ambulance Barn.

Attorney Brooks: Heard most of what Brad Marking said but not all. Will call him.

Will talk to Bruce about Property owned by Banisters. Will send draft letters to Mayor Jones and Bruce.

Carlson thinks it’s a good idea to have Attorney Brooks present whenever Sheriff and Judge Marking are on the agenda, to answer questions. Anytime the council wants me there in person, I can be there. Erickson isn’t sure why they are on the agenda when it doesn’t involve them. The agreement is with the county, not them.

Council Discussion/Future Agenda Items:

Report out from Council Committee Meetings:

• Infrastructure Committee Discussion: Vivirito- talked about water/sewer adjustments, guidelines for the council, an average of the month before or the month after. One adjustment per every 5 years. Director Sibley talked to Great falls and Laurel, they do not do adjustments, if it goes through the meter, they pay it.

• Golf Course meeting: Vivirito - They do a great job. Talked about asking Mayor to get on grant for new mower. Need to use some of the money they are making to build a cart barn, buy a fridge or purchase a POS system. They need a better security system per Sibley.

• Signal Peak Grant Application Discussion - Council agrees on priority for grant money, 1) Grass for playground. 2) Lights 3) Mower for Golf Course. Application is due April 15th. Turf grass will cost around $57,000.00, lights $46,000.00.

Clerk/Treasurer Lanter: Medical Insurance rates going up 3%.

Director Sibley: One bidder for site work on bathroom project was WHC out of Roundup ($86,331.17).

Benches are done, will work on getting them placed next week.

Funding from Bureau of Reclamation will pay for Phase 2 of the water project.

Toombs asked about fixing a stop sign on Main and 11th. Sibley will have his guys look at it.

Carlson was asked about a city noise ordinance on barking dogs and if we have a limit on how many dogs one can have. Sibley said they need to call the Sheriff’s office and file a complaint to issue a citation. City Ordinance says two dogs max for each household.

MOVED BY VIVIRITO, SECONDED BY ERICKSON TO APPROVE RESOLUTION #1156. A RESOLUTION OF THE CITY OF ROUNDUP, MONTANA ADOPTING MUSSELSHELL COUNTY MULTI-HAZARD MITIGATION PLAN 2021 UPDATE.

MOVED BY FISHER, SECONDED BY CARLSON TO APPROVE THE BID FOR THE RESTROOM PROJECT. ALL IN FAVOR. MOTION CARRIED.

Carlson asked why we are paying the county money for the Airport; nobody could answer that. Carlson will look into it.

COUNCIL CHAMBERS AND GOTO MEETING.

The meeting was called to order by Mayor Jones. Clerk/ Treasurer Lanter conducted roll call with council members, Liggett, Vivirito, Erickson, Carlson, McCleary, Toombs and Fisher present. Also, present was, Director Sibley and Assistant Clerk Mann. Attorney Brooks was present by video. Long was absent.

Moved by Carlson seconded by Toombs to approve the minutes of the April 5, 2022 meeting. All in favor. Motion carried.

Moved by Fisher seconded by Vivirito to approve agenda, adding Museum Board and Water Authority. All in favor. Motion carried.

Public Comment: No Comment.

Mayor Jones: Will table bill adjustment discussion, things may change when we get new water.

Meeting date with the County to discuss the Interlocal Agreement for Law Enforcement Services and the Interlocal Agreement Court Services will be May 9th at 6:00pm at the Senior Center.

Clerk School will be the first week in May. Lanter and Mayor Jones will attend the Conference.

Council meeting dates for May will be the 10th and 24th.

Sheriff Lesnik is concerned about current Marijuana Ordinance, would like two words changed.

Attorney Brooks: Sent letters to new and old owners of main street burned properties. Need to be in compliance by June 6th. Will be in Roundup for the May 9th meeting with the county. Will review Marijuana Ordinance. Will provide something in the next few weeks.

Bruce Hoiland: Two new home permits, one of them will need to be inspected by Lon and I to approve. Five Auxiliary building permits, and three fence permits were issued.

Will need additional funds, $17,000.00 in budget to fill that hole. Toombs asked if Bruce got a bid to fill the hole. Yes, a local person, per Bruce.

Correspondence: Clerk Lanter mailed everyone the letter received from the Highway Department. Mayor Jones will ask someone from the Highway Department to come to a meeting to discuss further, possibly ask local guy (Ron Armstrong) to discuss with council.

Unfinished Business:

• Law Enforcement Interlocal agreement sent to county: Mayor Jones hasn’t heard anything back from Commissioners. Will discuss at the May 9th meeting with the County.

• Signal Peak Application: Signal Peak will have a meeting May 2nd at 5:00 will be held at the city office. Mayor Jones would like Director Sibley and Councilmember Vivirito to attend to talk about lights and turf for the park if Board has questions.

Council Discussion/Future Agenda Items:

Report out from Council Committee Meetings:

• Museum Board: Carlson - Tom and Beth Hebert (Paleontologists) presented to the board. Are working a site and would like to donate to the museum. Looking for support from the council. Approximately 30 people would be onsite, they would spend money eating and sleeping in the community, also has a foundation that works with veterans. Carlson will give Mayor Jones their contact information for her to invite them to a council meeting.

• Water Authority: Sibley - Pre-construction meeting last Wednesday. Should start Phase 1 soon. Bid for Phase 2 in the fall and construction next summer.

• Toombs - concerned about Weir building getting worse, roof blowing off and bricks separating, wants a letter sent to owner, safety issue for everyone. Lots of people here for the 4th of July. John Rae was called, his excuses were, shortage of money and no payment from fire. Not invested in doing anything per Hoiland. Mayor wants another letter sent and Attorney Brooks will follow-up if nothing is done.

• Toombs - Curb and gutter should be required for all new construction and would like the ordinance revisited.

• Salaries Committee discussion: Erickson-Cost of living went up 5.9% and minimum wage is up .35 an hour. Ist option would be an individual percentage raise, and 2nd would be a flat rate for everyone in the amount of $2.06 an hour. Also discussed a $100.00 a month increase for Attorney Brooks. Council agrees on $2.06 increase and $100.00 a month for Attorney Brooks. Will put as action Item at next meeting.

• Draft Court Services, Interlocal agreement: Mayor Jones went over changes. State Statue says we need to add compensation clause. Mayor will send council and Attorney Brooks a clean copy to look over for the meeting on May 9th.

• Pool: Toombs - we hired 12 to 14 Lifeguards, a pool manager (Robin Sibley) and an assistant manager (Savannah Wolff). Deanna and Sheila are willing to help out when needed.

Clerk/Treasurer Lanter: Mailed Audit Report finding to council.

Director Sibley: Received a call from Theresa Doumitt, would like angle parking in-front of kiosk. He thinks it’s a bad idea. Carlson doesn’t think that would work, it’s a truck route. Council agrees.
