REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ROUNDUP HELD ON NOVEMBER 1, 2022 AT 7:00 P.M. IN THE CITY COUNCIL CHAMBERS AND GOTO MEETING.The meeting was called to order by Mayor Jones. Clerk/ Treasurer Lanter conducted roll call with council members, Liggett, Erickson, Vivirito, McCleary, Toombs, and Fisher present. Also, present were Director Sibley and Assistant Clerk Mann. Attorney Brooks was present by video. Long and Carlson were absent.

MOVED BY VIVIRITO SECONDED BY ERICKSON TO APPROVE THE MINUTES OF THE OCTOBER 18, 2022 MEETING. ALL IN FAVOR. MOTION CARRIED.

MOVED BY ERICKSON SECONDED BY LIGGETT TO APPROVE THE AGENDA. ALL IN FAVOR. MOTION CARRIED.

No public comment.

Visitor: Morgan Belveal and Theresa Doumitt of RCP (Roundup Community Partners) -Would like to submit an application to the Montana Main Street impact grant program for wayfinding signs. Proposed project would cost $60,000.00, Grant requires a match. Deadline is November 30th. Morgan Belveal-People stay with me for weeks before they find some of our special places. Morgan would be the grant administrator and would like the city to sponsor. Toombs- Raise what you can and I’ll come up with the rest. Council agrees on giving a letter of support from the city. Mayor Jones will draft one. Law Enforcement: Undersheriff Bednar gave Clerk/Treasurer a copy of calls for service.

Mayor Jones:

• MDT (Montana Department of Transportation) meeting will be held December 6th at 5:45pm, will send Law enforcement an invite.

• Beth Shumate with FWP encouraged and is supportive of mayor moving forward with a Parks & Trails Plan.

• Will meet with Bev Eiselein and Linda Yount November 9th, would like Parks Committee to attend.

• Electric Service shop is moving forward with the lights at the park.

• Will talk to Lon tomorrow about the 15 mph signs that need to be put up on 10th Ave.

Attorney Brooks: City Ordinance 22 1-15 gives the city authority to require owners to maintain the trees on the boulevard.

KLE Construction owner was sent a letter to step up and make repairs to Main Street. Asked for a refund of a little more than $22,000.00. She said she would follow-up, I will let the Mayor and Council know what comes of it, whether it be negative or positive.

First reading of ordinance for repealing fumes will be next meeting.

Unfinished Business:

• Fireworks Ordinance: Tabled, will continue after the first of the year.

Report out from Council Committee Meetings:

• Infrastructure Committee: Liggett reports- Committee agrees to a water adjustment for 405 5th St W due to a leak while homeowner was gone. Adjustment will include late fee. Council agrees.

SID for 1201 5th St W. Committee had two options, they chose the second option which is to send homeowner a letter with Montana Code Annotated statue and rules on Special Improvement Districts and let her go from there. Mayor Jones will draft the letter and have the committee word smith it.

• Stockman Bar lot sale discussion: Mayor Jones-Should be finished soon. Talked with two Realtors. Lot is 25x140, Emma Fraser stated that lots are going for $3.00 a ft. Worth $10,500.00, might want to start the bid at $5,000.00. City has the Deed on the property. City can put restrictions on it. Money can go into TIF District. Will ask Cathy Barta with Snowy Mountain Development for a template to help us. Fisher doesn’t want to limit it too much. Toombs agrees.

• Sheriff Lesnik wants the city to create an ordinance to prohibit sale of marijuana products: Sheriff Lesnik-Products are being sold at the vape shop in the city that have Delta 9 TCH in them. No restrictions and is unregulated, it can be sold to a 5-year-old, it’s still a drug. Sheriff Lesnik showed a picture to the council of what is being sold. Musselshell County is a red county. Would like Musselshell to be a dry marijuana county. Mayor and Attorney Brooks don’t know of any dry counties in Montana. Mayor Jones will ask on list serve what others are doing. Attorney Brooks will reach out to Kristan Barbour from the Montana Department of Revenue, could also send a letter the State Attorney General. Director Sibley: Received grant from Coal Board for ADA (American Disability Act) improvements at the stage area. Two bids were received. Ray Construction for $82,250.00 and WHC for $68,252.75. Will have as an action Item at next meeting. A couple blocks within the phase 6 may not get paved until next year.

Restroom project pushed back until December.

Will have a walk through with COP Construction Friday morning, will look at any cleanup that needs to be done for phase 6 of the project.

Liggett has a request from people on 4th St, would like speed bumps put in when they pave.
