MUSSELSHELL COUNTY STAGE II FIRE RESTRICTIONS AND EMERGENCY PROCLAMATION

WHEREAS, on June 18, 2021, the Musselshell County Commissioners passed Resolution 2021-19 imposing Stage One Fire Restrictions. The Musselshell County Commissioners passed Resolution 2021-22 on June 28, 2021 imposing Stage Two Fire Restrictions with an effective date and time of 12:01 a.m. June 29, 2021;
WHEREAS, high temperatures, low humidity and low precipitation have continued further increasing the EXTREMELY HIGH wildland fire danger within the entirety of Musselshell County's border; and
WHEREAS, several adjacent counties are currently under Stage Two Fire Restrictions; and
WHEREAS, the Musselshell County Board of Commissioners declare that all private land in Musselshell County not under the jurisdiction of municipalities or State or Federal agencies is a high fire hazard area across all of Musselshell County;
WHEREAS, the Musselshell County Commissioners recognize that a state of emergency now exists because of the ongoing and continued lack of precipitation with no foreseeable abatement of the atmospheric conditions in the near future;
WHEREAS, "Emergency" means the imminent threat of a disaster causing immediate peril to life or property that timely action can avert or minimize. The Musselshell County Commissioners may declare an emergency before an emergency situation arises in fact in order to prevent or avert damage to property or risk to life;
WHEREAS, in addition to Stage Two fire restrictions, the Musselshell County Commissioners are now acting ahead of the July 4, 2021 Holiday to avert or minimize what is an imminent threat of a disaster from wildfire creating peril to life or proper ty from man-made risks.
IT IS HEREBY RESOLVED AND PROCLAIMED by the Musselshell County Commissioners that Stage Two Fire Restrictions that are now in effect for all private lands in Mussels hell County due to EXTREMELY HIGH wildland fire danger and IT IS FURTHER DECLARED that Musselshell County is in a state of emergency for risk to life and property from wildfire that is human caused.
IT IS FURTHER RESOLVED and ORDERED, that all activiti es prohibited under Stage Two Fire Restrictions in place as of June 29,2021 (Resolution 21-22) remain in place and are in add ition to this Declaration of Emergency. It is further ordered that in addition to Stage Two Restrictions, fireworks and any other man-made incendiary devices or products including Tannerite targets or like products, tracer ammunition, or any other incendiary product or device that is under the control of humans and capable of igniting afire is banned from use on all private and county properties where any ignitable and flammable vegetatio n or flammable material exists until further notice and until s uch time as the emergency conditions have been abated in the discretion of the Musselshell County Commissioners and the emergency declaration is lifted by the Board. BE IT FURTHER RESOLVED, this resolution shall remain in effect from 12:01 on J une 29, 2021until such time as it may be amended or rescinded by the Board of County Commission ers. The County Commissioners grant the Musselshell County Fire Warden Justin Russell the authority to review a nd approve exemption requests.
