Commissioner May 26, 2020 minutes

The meeting was called to order at 8:30 by Commissioner Borner. Commissioner Carlson was present.

There was no public present.

Commissioner Carlson made the motion to approve the agenda as is. Commissioner Borner seconded the motion. Motion carried.

Commissioner Carlson made the motion to approve the minutes from the May 18, 2020 meeting after a few clarifications. Commissioner Borner seconded the motion. Motion carried.

Commissioner Carlson had the Musselshell County Financial Advisory Board Meeting on May 20, 2020. Minutes are available for review at the Clerk & Recorders Office.

Commissioner Borner had a Mental Health Center meeting and there was not a lot to report. They are working on solutions to deal with COVID-19. The Commissioners need to check on how the Earmarked Alcohol Tax money is being used and report it.


Maintenance Supervisor Jett gave her weekly report to the Commissioners. The RO system at the Commons is not working and will be repaired. Ms. Jett is going to contact HRDC regarding their program that has kids to help with summer maintenance. Extension Office issues were discussed.

Safety Committee Secretary Widmier met with the Commissioners regarding Workers Comp.

Road and Bridge Supervisor Stockert and Secretary Kenner gave their weekly report to the Commissioners. The Airport project was discussed. The engineers being used never contacted the Road Department regarding it’s plans to use the Road Department to resurface an access road. The Road Department has a set budget and the milling preservation of this access road would add to an already overburdened road maintenance budget. The Road Department would have never have chosen to put the millings on the road for this reason. The road Department would like the millings to be stockpiled at the East site for use on the Emergency Route for #4 Road. Today it is very wet but they are attempting to blade Fishel, Fattig and checking North roads. Last week they bladed Hochmuth, Harvey Hawk Crk, Fattig Crk, Mosby, Golf Course, Goulding Crk and Snowy Mtn.

Sheriff Lesnik gave his weekly report. There wasn’t anything new to report. The budget was discussed.

DES Coordinator Harper and Fire Warden gave their weekly report to the Commissioners. Rich Durgin joined the meeting. More of the FEMA properties were demolished over the weekend. There will be a Fire Council meeting June 4th, 2020. There was a COVID-19 update. Commissioner Borner told Mr. Harper that the County Agent will be contacting him regarding a Floodplain Permit for the Campground. They are going to be putting in a vaulted latrine in the future.

Under Sheriff Bednar and Victim Witness Advocate Allen joined the meeting to discuss a burn permit violation case. Mr. Durgin left the meeting.

County Agent Fosjord gave her weekly report to the Commissioners. The truck that is used for the fairgrounds needs some repairs. The Commissioner’s mentioned sharing the truck the maintenance crew uses with the fairground’s caretaker. They are going to be working on making the walking trails handicap assessable. Ms. Fosjord is getting her 4H Fair plan to the Health District. There will be an estimate for fans in the horse barn soon. Ms. Fosjord asked for a new computer for her assistant. The one she has is very old and very slow. Commissioner Carlson asked if Ms. Fosjord could ask caretaker Donahue if he could install solar lights on the flag poles at the South cemeteries. The Commissioners are going to be doing a resolution today to close overnight camping at the Cowbelles Campground unless they are in a self-sustained RV until the COVID-19 crisis is over.

Ambulance Director Solberg met with the Commissioners to discuss computers and the School wanting to put some panels on the emergency tower.

Adele Fields with the Melstone Area Foundation met with the Commissioners to discuss the property in Melstone. Commissioner Borner is going to talk to Attorney Meloy to see what the options are and will get back to her.

Rose Snider met with the Commissioner to discuss the fees at the dump.

Scott Graham, Collette Le Mieux and Ted Decker with DEQ met with the Commissioners to let them know they are going to be going out for pre-bid on the Bair-Collins reclamation project. They also wanted to discuss the truck route that will be used for the project. Mr. Graham will also be in contact with Road and Bridge Supervisor Stockert and City Works Director Sibley regarding the route.

Public Comment was opened up at 3:26.

There was no public comment.

Commissioner Carlson made the motion to review and sign the State of Montana Standard Lease Contract for Lease #4715 between the State of Montana, Department of Justice, Motor Vehicle Division, Driver Service Bureau and Musselshell County. Commissioner Borner seconded the motion. Motion carried.

Commissioner Carlson made the motion to suspend the rules to sign a Resolution to close the Cowbelles Campground to overnight use during the COVID-19 crisis. Commissioner Borner seconded the motion. Motion carried.

Commissioner Carlson made the motion to sign Resolution 2020-15 shutting down Cowbelles Campground to overnight camping unless they have a self-sustained RV until the COVID-19 crisis is over. Commissioner Borner seconded the motion. Motion carried.

There being no further business the motion was made to adjourn. Motion carried.

The Commissioner did claims on Thursday May 21, 2020.
